A Trust is a “roadmap” for your heirs and often helps your estate avoid the costs and time associated with a court involved probate. A trust allows you to fund it with specific assets (a primary residence, investment accounts, other real and personal property) and gives the creator of the trust the ability to control the distribution of specified assets even after death.
Similar to a Trust, a Will, but with court supervision, allows you to decide who will receive your assets and how they are distributed. This is often achieved through a court supervised process called Probate. At the Law Office of Eric Bohman, we often use what is called a “pour over” Will which allows your estate administrator(s) to “pour” those assets not properly placed into Trust into that trust which saves the client time and money.
